Reporter 'disses Citizens' Lawyer
Newspaper hides/distorts Business Partner's Plan Editor's Note: Will Lancaster Newspapers go much lower? Their lawyers - Barley Snyder (click to go to their website) were representing their business partner Dale High in front of the Manheim Township Commissioners. What can we conclude when their reporters show such open disrespect for the public? What can we conclude when the newspaper goes out of their way to distort and bury stories? This situation is tragic for Lancaster County! Lancaster Newspaper's business partner Dale High apparently has "The Crossings" shopping mall WIRED! Want proof? It's coming, but first we have an email response from Dale High's business partner's employee, Intell reporter Carla DiFonzo. DiFonzo wrote a Tuesday story entitled, "Traffic fears still beset 'Conestoga Creek' plan". The citizen's lawyer, Bill Cluck, wrote a lengthy email to DiFonzo with a list of corrections and misperceptions about the story - pointing out that she never talked to or contacted him. While her reply was friendly enough, Cluck's follow-up email included another suggestion for a story thread and was answered in what can only be described as "trash talk"! (Editor's note: Please let me apologize in advance for the R - rated language.)

How is that for an open minded reporter?! As of press time, Lancaster Newspaper CEO Harold "Chip" Miller did not respond to an email request regarding the newspaper's reporting policy with their business partner Dale High. One of the most dramatic revelation during the almost 8 hour hearing was proof that the entire Manheim Township board has considered themselves PARTNERS with High Real Estate Group for almost a year and half on this project! President of the Board, Carol Simpson wrote a letter to U.S. House of Representative Joe Pitts. Simpson declared, "We are working in close partnership with High Real Estate Group to advance this project."!! She goes on to ask that your tax dollars be given for the road improvements saying that they "...will promote economic development within Manheim Township by providing the public infrastructure necessary to serve the mixed use, lifestyle-type development adjacent to the intersection."! The letter raise many questions such as: The board refused Cluck's request that he be allowed to ask the commissioners questions about their relationship with High and the project. This fact will all most certainly allow an appeal. Can the commissioners, who describe themselves as "partners" be an impartial judge of the hearing? That's what the law requires. Min. Inc. v. Zoning Hearing Bd. of Wharton Township, 597 4 , A.2d 219 (Pa. Cmwlth. 1991). The Court recognizes that due process requires a local governing body in the performance of its quasi-judicial functions to avoid even the appearance of bias or impropriety. A showing of actual bias is unnecessary in order to assert a cognizable due process claim; the mere potential for bias or the appearance of non-objectivity may be sufficient to constitute a violation of that right. Amazingly, Simpson's letter, on behalf of the board, is exactly the conditions why a Pennsylvania Commonwealth judge said a recusal is needed (they can't be the judge). That precedent case is called Prin v. Council of the Municipality of Monroeville, 645 A.2d 450. It's clear by the aggressive hearing schedule that the commissioners are pushing this hearing through as quick as possible. Will a judge ultimately throw their decision out? Time will tell but United States Senator Arlen Spector announced last week (click here to read press release) that he and Junior Senator Bob Casey secured $2,000,000 for the estimated $25 million needed for the road improvements.
